4.1 Nature of AI-Generated Content

ColorNest uses artificial intelligence (“AI”) models to create coloring pages, coloring books, story books, and learning packs based on your selections and preferences. AI-generated content is produced through probabilistic algorithms that may produce different results even when given identical inputs. We do not guarantee that: (a) any two generations will produce identical outputs; (b) generated content will be free from imperfections, stylistic inconsistencies, or errors; (c) generated content will meet your subjective aesthetic or educational expectations; or (d) all visual elements will render perfectly (including, but not limited to, accurate character counts, letter formations, scene composition, or anatomical accuracy).

4.2 No Warranties for AI Content Quality

AI-GENERATED CONTENT IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

ColorNest does not warrant that AI-generated content will be error-free, appropriate for all children, or suitable for any specific educational, developmental, or creative goal. You acknowledge and accept these limitations each time you initiate an AI generation. ColorNest has implemented automated quality control measures to reduce imperfections, but we cannot guarantee perfection or meeting individual expectations.

4.3 Educational Content Limitations

Educational content within ColorNest (including but not limited to alphabet letters, counting exercises, shape recognition, and learning packs) is intended as a supplementary tool only and is NOT a replacement for formal, structured educational instruction or professional educational materials. AI may occasionally produce counting errors, letter reversals, stylistic inconsistencies, or other inaccuracies. Parents and educators must independently evaluate whether generated content is appropriate for the child’s age, learning level, and developmental needs. ColorNest does not claim that any generated content meets Common Core standards, curriculum requirements, or any other educational benchmark.

4.4 Quality Control Process

ColorNest uses a multi-tier quality control system involving automated AI-based review to filter out content that falls below minimum standards. However, this process is not exhaustive. Some imperfect or unexpected outputs may still reach you. If you believe generated content falls significantly below reasonable expectations, see Section 5.3 (Credit Restoration for System Errors).

4.5 Use Rights and Restrictions

You may use AI-generated content for personal, non-commercial purposes, including printing and coloring by you and your family, sharing with family or your child’s classroom (non-commercial sharing), and storing for personal digital or physical use. You may NOT sell, resell, or monetize generated content; use generated content for commercial purposes; claim ownership of generated content; or redistribute or republish it on public platforms without attribution to ColorNest.

4.6 Data Use for Service Improvement

You acknowledge that ColorNest may analyze AI-generated content outputs and your feedback (ratings, regeneration requests) to improve quality control algorithms and generation accuracy. We may share anonymized, aggregated insights with our AI service providers as permitted by their terms. We do not sell individual user data to third parties.

5.1 Credit System

ColorNest uses a credit-based system to manage access to AI-generated content. Credits may be obtained through paid subscriptions, credit pack purchases, promotional offers, or free trial credits. Credits are a non-refundable virtual currency with no monetary value and cannot be exchanged for cash.

5.2 Non-Refundability

Credits are non-refundable as cash under any circumstance, including dissatisfaction with the aesthetic or quality of generated content, changes in preferences, failure to use credits before expiration, or voluntary account closure.

5.3 Credit Restoration for System Errors

If a generation request fails due to a ColorNest system error (server outages, timeout errors, payment processing failures, or failed uploads), credits will be automatically restored to your account within 24 hours. If a generation completes but produces content that is fundamentally incomplete or visually corrupted, you may request credit restoration by contacting support@colornest.ai with your account email, the Book ID or Generation ID, and a brief description of the issue.

5.4 Quality Dissatisfaction vs. System Error

Credits are NOT restored for subjective quality dissatisfaction (e.g., “the dinosaur looks wrong” or “I don’t like the style”). These are inherent characteristics of AI generation. ColorNest reserves the right, at its sole discretion, to issue goodwill credit restorations in cases of repeated issues or demonstrated hardship, but is under no obligation to do so.

5.5 Subscription Refunds

Premium subscription refunds are governed by Stripe's standard billing policies and your applicable jurisdiction’s consumer protection laws. You may cancel your subscription at any time through your account settings. No partial-month refunds are issued.

9.1 Cap on Total Liability

COLORNEST’S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID TO COLORNEST IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM OR $50, WHICHEVER IS GREATER.

9.2 Exclusion of Consequential Damages

IN NO EVENT SHALL COLORNEST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF DATA, REPUTATIONAL HARM, EMOTIONAL DISTRESS, OR COSTS OF SUBSTITUTE SERVICES.

This exclusion applies even if ColorNest has been advised of the possibility of such damages.

9.3 AI Content-Specific Disclaimer

ColorNest shall have no liability for: (a) AI-generated content that does not meet your subjective expectations, aesthetic preferences, or desired themes; (b) any educational inaccuracies, errors, or omissions in AI-generated educational content; (c) your reliance on AI-generated content as a substitute for formal educational materials or professional instruction; (d) any child’s developmental, behavioral, or learning outcomes related to use of ColorNest content; or (e) inappropriate or unexpected content generated by the AI.

9.4 Third-Party AI Services

ColorNest uses third-party AI services to generate and review content. ColorNest is not liable for failures, errors, or unexpected outputs from these third-party services, including service outages, unexpected image generation, changes in model behavior, or discontinuation of services.

9.5 Severability

If any provision of this Limitation of Liability section is found to be unenforceable, the remaining provisions shall remain in full force and effect. ColorNest’s liability shall be limited to the maximum extent permitted by law in your jurisdiction.
